ADA For Websites

Who is required to have an ADA compliant website in the United States?

The Americans with Disabilities Act (ADA) requires that certain businesses and organizations provide accessible websites to ensure equal access for people with disabilities. While the ADA itself does not explicitly mention websites, the Department of Justice (DOJ) has asserted that the ADA's requirements apply to websites as well.

As of my last knowledge update in January 2022, there isn't a specific list of entities required to have ADA-compliant websites. However, the ADA generally applies to places of public accommodation, and this can include businesses that operate online. The DOJ has primarily focused its enforcement efforts on websites of businesses falling into categories such as:

  1. Retailers and Service Providers: Businesses that sell goods or services, especially those with a physical presence (e.g., stores, restaurants).
  2. Financial Institutions: Banks, credit unions, and other financial services.
  3. Educational Institutions: Schools, colleges, and universities.
  4. Government Entities: Government websites, at the federal, state, and local levels.
  5. Healthcare Providers: Hospitals, clinics, and other healthcare facilities.

It's important to note that the legal landscape regarding web accessibility is evolving, and there may be updates or changes to regulations. Additionally, some states have enacted their own laws regarding web accessibility.

To ensure compliance and stay updated on the requirements, it's advisable for businesses and organizations to consult legal professionals familiar with ADA regulations and to consider Web Content Accessibility Guidelines (WCAG) as a reference for making websites accessible. WCAG provides guidelines and success criteria to help make web content more accessible to people with disabilities.
